TERMS AND CONDITIONS

Accessing this website and/or placing an order means you agree to be bound by the terms and conditions set out in the paragraphs below

For clarity, the following terms shall have the meanings set out below:

    "Seller" shall mean Tringmotion Ltd as per the details stated later in the terms
    "Buyer" shall mean any person, partnership or body corporate detailed in the appropriate section of the sales invoice/order form/delivery note.
    "Goods" shall mean the item/s detailed in the appropriate section of the sales invoice/order form/delivery note.
    "Price" shall mean the sum due to the Seller from the Buyer for the Goods and shall include VAT at the appropriate rate unless otherwise stated.
    "Working day" or "Calendar day" shall mean any day excluding Saturdays, Sundays and public holidays.

To maintain our quality standards, we may monitor and record calls to enable us to ensure the highest level of service to our customers.

The right to refuse or restrict any order is reserved. Specifically there may be some regions where there are legal variances on new supply. Specifically we only deliver within the UK VAT area.

Products are subject to ongoing research and development, Tringmotion reserves the right to dispatch products with upgraded components to the original payment. This would include items such as battery capacity upgrades and braking component updates. Customers who have specific requirements are advised to add notes at the time of order.

First Order

Your first order must be delivered to the address your card is registered to. This is to protect you from the increased threat from Internet and Credit Card fraud.

Payments

By credit & debit cards:

We accept all major credit and debit cards. Your card will be charged for the full value of your order on authorisation.

Please note we do not accept card payments over the telephone and online payments will not be accepted when verification is circumvented.

Delivery

Our aim is to deliver your order within 3-5 working days from despatch, subject stock availability & excludes Sale periods. Please allow 7-10 working days for delivery of non-stock items.

We deliver throughout the UK Mainland using our courier network.

Deliveries to other territories by request only and may be subject to additional fees.

Delivery Charges

Delivery charges will be notified in advance of any order.

Prices

The prices quoted are those ruling at the time of production. Due to circumstances beyond our control, prices may have to be altered up or down, including any alterations due to the rate of value added tax. The correct price will be shown on your delivery note.

These prices include VAT but exclude delivery costs, which will be added to the total amount due as set out in our Delivery Guide.
We are under no obligation to provide the Product to you at the incorrect (lower) price, even after we have sent you a Dispatch Confirmation, if the pricing error is obvious and unmistakeable and could have reasonably been recognised by you as a mis-pricing.

Promotions

All promotions have an expiry date. Please check this before placing your order. To qualify for the correct promotion please quote the Promotional Code which can be found on promotional material or order form.

Promotional discounts will be applied to all items; any items returned will be refunded minus discount.

Products distributed on alternate platforms may have different terms and conditions to the main website, please check before ordering.

Availability

All stock (including free gifts) is subject to availability. We will advise of current due in date at time of ordering if order is placed by web or telephone. If this date changes & is estimated to be due 7 days or later, we will inform you in writing. Any orders placed via mail order will receive written confirmation of expected due in date.

For the purpose of current EU consumer contract legislation all promotions associated with orders from Tringmotion Ltd (including free gifts, prices, discounts, multi-buy savings and any other similar offers) will cease to be valid when stock is no longer available, unless otherwise stated.

Colour Reproduction

Every care has been taken to ensure that the product descriptions and specifications are correct. The limitations of colour reproduction may mean a slight variation from the actual products can occur.
Purchases - For Consumers

    1 This section applies to consumer purchases only
    2 If you wish to cancel your placed order:

        (a) you can notify us by email or via the contact us page before the goods are dispatched; or
        (b) where goods have already been dispatched to you, by notifying us in writing either at our registered address or by emailing or via the contact us page in accordance with clause 3.

    3 You may change your mind and return goods ordered from us for any reason at any time within 14 days of receipt starting the day after receipt for a full refund or exchange, subject to the following conditions;

        3.1 You must inform us in writing of your cancellation,by post at our registered address, by emailing or via the contact us page within 14 days of your receipt of the goods.
        3.2 You must return the goods to us at your expense. Please see RETURN OF GOODS below for further details
        3.3 You must take reasonable care of the goods while you are responsible for them and to see they are received by us without damage.
        3.4 You accept full responsibility for the goods until they are received by us, in a satisfactory condition and are therefore advised to use a "signed for" and insured delivery service when returning goods.

    4 We will issue a refund of the purchase price of the goods and any associated initial delivery costs or an exchange credit as required within 28 days of your notice OR upon receipt of the return goods, whichever is the soonest. A deduction will have been made from your refund if we are required to collect goods from your premises equal to the cost of doing so.
    5 The rights to return the goods to us as referred to in clause 3 will not apply in the following circumstances:

        * to any products that we have made or customised specifically for you
        * to any products that by their nature have a limited lifespan
        * to any product where packaging seals have been broken where the seal is required to maintain the product.

    The provisions of clause 5 do not affect your statutory rights.
    6 You may return goods for any of the following reasons for a full refund or exchange, at no additional cost however please note the time conditions applied in LIABILITY for faulty, damaged or incorrectly delivered goods;

        6.1 Where goods arrive in a damaged or unsatisfactory condition. Please mark the delivery note when you sign for the goods to indicate that packaging is damaged or the goods are uninspected.
        6.2 Where goods are faulty.
        6.3 You must still take reasonable care of the goods whilst they are in your charge even if they are damaged/faulty on delivery and inform us of the nature of the damage.
        6.4 If required, we can arrange collection of damaged/faulty goods at a mutually convenient time (daytimes, Monday to Friday)

    7 Where a refund is due, we will make refund via the payment method you originally used for your purchase.
    8 Your refund may be delayed or reduced if;

        8.1 The goods are not received back from you in a timely fashion. We will process your refund within 28 days OR upon receipt of the goods, whichever is soonest.
        8.2 We have to collect goods from you, in which case the cost of collection will be deducted from your refund.

RETURN OF GOODS
    1 When you change your mind and cancel the contract to buy as above, please note that you enter in to a new contract for the return of our goods, the details of which are:

        (a) that you will return our goods to us at your expense
        (b) that you will return any additional related goods that may have been joint offers or associated gifts to us at your expense
        (c) that you will endeavour to return our goods to arrive with us, preferably within 14 days of your notice of cancellation. Please see Clause 2
        (d) that whilst you have responsibility of our goods, you will take good and reasonable care of them to maintain them in a fully re-saleable condition
        (e) that you will not use or attempt to fit/assemble the goods aside from your need to assess them for suitability.
        (f) that wherever practically possible, all product packaging is returned with the goods
        (g) that you will repackage the goods adequately and appropriately to ensure that they are received by us in a satisfactory condition by us at our registered address.
        (h) that you are advised to use an insured and signed for delivery service when returning the goods.
        2 Where goods have not been received by us within 14 days of your notice of cancellation we will:
            (a) we will arrange collection of goods at OUR expense at a mutually convenient time OR
            (b) you may return goods to us, and we will refund the cost of you doing so, however please check with us first as it is often cheaper for us to collect.
        2.1 Contact you to arrange to have our goods collected at a mutually convenient time during the following 10 working days (Saturday and Sunday are not working days)
        2.2 Advise you of the cost of collecting our goods
        2.3 Deduct the cost of collecting goods from you from any refund we might owe you.

    3 The conditions of the contract to return goods take effect as soon as we receive your written notice of cancellation.
    4 If you receive Damaged or Faulty goods OR we deliver incorrect or substituted goods where the substituted item(s) were not agreed to prior to despatch, either we will arrange collection of goods at OUR expense at a mutually convenient time or you may return goods to us, and we will refund the cost of you doing so, however please check with us first as it is often cheaper for us to collect.
    5 Exclusions. These terms are for distance sales, so over the counter and click and collect sales are excluded. These terms do not apply to hygene or personalised items.

Transfer of rights and obligations
the contract between you and us is binding on you and us and on our respective successors and assigns.
You may not transfer, assign, charge or otherwise dispose of a Contract, or any of your rights or obligations arising under it, without our prior written consent.
We may transfer, assign, charge, sub-contract or otherwise dispose of a Contract, or any of our rights or obligations arising under it, at any time during the term of the Contract.

Events outside our control
we will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under a Contract that is caused by events outside our reasonable control (Force Majeure Event).
A Force Majeure Event includes any act, event, non-happening, omission or accident beyond our reasonable control and includes in particular (without limitation) the following:
(a) Strikes, lock-outs or other industrial action.
(b) Civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war.
(c) Fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster.
(d) Impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport.
(e) Impossibility of the use of public or private telecommunications networks.
(f) The acts, decrees, legislation, regulations or restrictions of any government.
Our performance under any Contract is deemed to be suspended for the period that the Force Majeure Event continues, and we will have an extension of time for performance for the duration of that period. We will use our reasonable endeavours to bring the Force Majeure Event to a close or to find a solution by which our obligations under the Contract may be performed despite the Force Majeure Event.

Liability

(1) If the goods we deliver are not what you ordered or are damaged or defective or the delivery is of an incorrect quantity, we shall have no liability to you unless you notify us in writing at our contact address of the problem within 7 working days of the delivery of the goods in question.

(2) If you do not receive goods ordered by you within 28 days of the receipt of the notification of dispatch, we shall have no liability to you unless you notify us in writing at our contact address of the problem within 35 days of the receipt of the notification of dispatch.

(3) If you notify a problem to us under condition 2, our only obligation will be, at your option:

    (a) to make good any shortage or non-delivery;
    (b) to replace or repair any goods that are damaged or defective; or
    (c) To refund to you the amount paid by you for the goods in question in whatever way we choose.

(4) Save as precluded by law, we will not be liable to you for any indirect or consequential loss, damage or expenses (including loss of profits, business or goodwill) howsoever arising out of any problem you notify to us under this condition and we shall have no liability to pay any money to you by way of compensation other than to refund to you the amount paid by you for the goods in question under clause 3(c) above.

(5) You must observe and comply with all applicable regulations and legislation, including obtaining all necessary customs, import or other permits to purchase goods from our site. If you order Products from our site for delivery outside the UK, they may be subject to import duties and taxes which are levied when the delivery reaches the specified destination. You will be responsible for payment of any such import duties and taxes. Please note that we have no control over these charges and cannot predict their amount. Please contact your local customs office for further information before placing your order.
Please also note that you must comply with all applicable laws and regulations of the country for which the products are destined. We will not be liable for any breach by you of any such laws.

(6) Notwithstanding the foregoing, nothing in these terms and conditions is intended to limit any rights you might have as a consumer under applicable local law or other statutory rights that may not be excluded nor in any way to exclude or limit our liability to you for any death or personal injury resulting from our negligence.

Product Specifications

Manufacturers are continually developing their products. As a result, goods may be of a revised specification from those advertised. If a particular feature is of specific importance, it is advised that checks are made prior to purchase. A client agrees to purchase the manufacturer's supplied specification.

Validity of Website

No indemnity is provided against out of date elements on the website. The company makes no undertaking over website maintenance.

Waiver
If we fail, at any time during the term of a Contract, to insist upon strict performance of any of your obligations under the Contract or any of these terms and conditions, or if we fail to exercise any of the rights or remedies to which we are entitled under the Contract, this shall not constitute a waiver of such rights or remedies and shall not relieve you from compliance with such obligations.
A waiver by us of any default shall not constitute a waiver of any subsequent default.

No waiver by us of any of these terms and conditions shall be effective unless it is expressly stated to be a waiver and is communicated to you in writing.

Severability

If any of these terms and Conditions or any provisions of a Contract are determined by any competent authority to be invalid, unlawful or unenforceable to any extent, such term, condition or provision will to that extent be severed from the remaining terms, conditions and provisions which will continue to be valid to the fullest extent permitted by law.

Entire agreement
These terms and conditions and any document expressly referred to in them represent the entire agreement between us in relation to the subject matter of any Contract and supersede any prior agreement, understanding or arrangement between us, whether oral or in writing.
We each acknowledge that, in entering into a Contract, neither of us has relied on any representation, undertaking or promise given by the other or be implied from anything said or written in negotiations between us prior to such Contract except as expressly stated in these terms and conditions.
We intend to rely upon these terms and conditions and any document expressly referred to in them in relation to the subject matter of any Contract. While we accept responsibility for statements and representations made by our duly authorised agents, please make sure you ask for any variations from these terms and conditions to be confirmed in writing.

Our right to vary these terms and conditions
We have the right to revise and amend these terms and conditions from time to time to reflect changes in market conditions affecting our business, changes in technology, changes in payment methods, changes in relevant laws and regulatory requirements and changes in our system's capabilities.
You will be subject to the policies and terms and conditions in force at the time that you order products from us, unless any change to those policies or these terms and conditions is required to be made by law or governmental authority (in which case it will apply to orders previously placed by you), or if we notify you of the change to those policies or these terms and conditions before we send you the Dispatch Confirmation (in which case we have the right to assume that you have accepted the change to the terms and conditions, unless you notify us to the contrary within seven working days of receipt by you of the Products).

Law and jurisdiction

Contracts for the purchase of Products through our site will be governed by English law. Any dispute arising from, or related to, such Contracts shall be subject to the non-exclusive jurisdiction of the courts of England and Wales.

Bikes Purchased online

The products on the website are designed leisure use.  For goods purchased on Direct Delivery, it is the Buyers responsibility to ensure the bike is correctly assembled, set-up, adjusted and safe to use. As with all products of this nature, the Customer agrees to use at their own risk.  Injury as a result of misuse or inexperience is the sole responsibility of the Customer.

Service Repairs

Tringmotion will carry out the work to your bicycle as shown on the work order created for you when you dropped off your bicycle in store.

Prior to carrying out any work, our mechanics will undertake an assessment of your bicycle to determine the condition of your bicycle and may contact you to advise of any additional work that may be required and/or parts that may require replacing and the costs of this work. If parts are to be retained, this must be provided in advance and in writing.

Tuning Devices
The use of a tuning device on an ebike is a road traffic offence. No bike with one of these fitted will be knowingly repaired

e-bike conversion
The OEM will not have homolgated the bike for such a conversion so these bikes will not be offered service.

A standard condion of engagement is automatic authorisation of work up to £50 in addition to the service fee. However, if you choose not to follow our recommendations on repairs quoted above this price, we cannot guarantee that your bicycle will work as it should and we accept no liability for any defects arising with the bicycle as a result of not having this work undertaken.

There may be occasions where it is necessary for us to sub-contract the work (or part thereof) to a third party. However, we will remain responsible for the actions of any sub-contractor and this will not affect your statutory rights.
Completion of work

We will endeavour to complete any work to your bicycle as soon as possible and within the estimated time scales that we have provided you with. However, there may be times when this is not possible and time for completion of this work will not be of the essence.
Price & Payment

The price for the work (including any additional work which you have authorised us to carry out) will be as quoted to you by the store staff.

Payment in full is required on completion of any work undertaken to your bicycle and prior to the return of your bicycle. Tringmotion reserves the right to retain your bicycle until you have paid in full.
Collection of Bicycles

You must collect your bicycle within 7 days of Tringmotion notifying you that it is available. If you fail to do so, we will provide you with a written notice (which includes email) notifying you that you have 21 days to collect your bike, failing which we may sell the bicycle to recover costs. Storage charges of £5 a day will also apply.

Tringmotion is entitled to deduct any outstanding payment due from you for the work from the proceeds of any sale of your bicycle, together with any costs of sale, and if applicable, we will then send you a cheque for the remaining proceeds of the sale.
Warranty

Subject to the remainder of this clause, all replacement parts provided by Tringmotion as part of this service will be guaranteed for the period specified by the parts manufacturer, and all labour and workmanship is guaranteed for a period of 6 months, commencing from the date of the work being undertaken.

This warranty is subject to you:

(a) maintaining the bicycle in accordance with the manufacturer’s warranty;
(b) providing proof of purchase of the service / repair; and
(c) allowing Tringmotion to carry out the repair work required.

This warranty is not valid where, in Tringmotion’s reasonable opinion, defects with the bicycle have occurred due to fair wear and tear, improper use, criminal or malicious damage, fire, theft, instances where the bicycle has been used in an incorrect manner or you have continued to use the bicycle after the defect or fault developed.
Risk

Any personal items left on the bicycle when it is provided to Tringmotion are left at the customer’s own risk and Tringmoiton accepts no liability for any loss or damage to these items. We recommend you remove any such items prior to dropping off your bicycle.
Liability

If we fail to comply with these conditions, we will attempt to repair the issue for you as soon as possible, which may include providing you with replacement parts.

Under no circumstances will we be liable to you for any indirect or consequential loss, damage or expenses (including loss of profits, business or goodwill, stress or inconvenience) howsoever arising out of any problem you notify to us under these terms and conditions and we shall have no liability to pay any money to you by way of compensation other than to refund to you the amount paid by you for the service.

Nothing in these terms and conditions is intended to limit any of your statutory rights or in any way to exclude or limit our liability to you for any death or personal injury resulting from our negligence.
General

Tringmotion amends these terms from time to time. The terms in force at the time of the work being undertaken apply to the Contract between you and us.
